I see you put 'trying'. If by 'trying' you mean they thought about it, but NEVER got/used it, then no, they shouldn't be banned.
No, as in actually went through admittedly attempting to purchase it with credit card details etc.
Purchasing and using the software are 2 different entities, IMO.
The act of purchasing the software is not ban worthy.
Using the software while playing this game, on the other hand, is a serious breach of TOS, and is a bannable offense.
Just wondering, since WGT has a policy of banning/suspending players they suspect of cheating in other ways (multiple accounts etc.)
Ban first, psychoanalysis second.
If the "intent" is proven...GUILTY! Ban them!

If the software was bought, the person should have his/her account disabled. This is just a game after all right? Why cheat, what is the fun in that??? I guess if you want the prizes bad enough, BUT this person has to live with his/her self everyday and that wouldn't be fun, knowing you took prizes away from people who were playing honestly.
Like I have said before opinions are like bleep holes everyone has one!!!
